Applicant and owner Amanda Hubbard proposes the construction of two sections of fence totaling 28 feet in length that are each 78 inches (six feet, six inches) tall in front of the building line.  The maximum allowable height for a fence in front of the building line is 36 inches.  Property is located in an R2, Single- and Two-Family Residential District.

Variance Request: Request a variance to exceed the maximum allowable height of a fence in the front yard by constructing two sections of fence in front of the building line as proposed.  Pursuant to 1153.02(a), (Ord. 124- 05. Passed 2-6-2006).

Applicant David Harala of DHA Architects Ltd. proposes the construction of a kitchen addition that will project into the side yard.  The distance to the east property line is reduced to three feet, two inches.  The required minimum side yard depth is five feet. The required minimum for combined side yards is 15 feet.  As proposed, the total for combined side yards is reduced to 14 feet.  Request two variances.  The property is in an R2 Single and Two-Family Residential District.

First Variance Request: The minimum required side yard setback for primary structures is five feet.  Request a variance to reduce the side yard setback on the east side of the property to three feet, two inches as proposed. Applicant Amy Armour of Beegan Architecture proposes the construction of a single story 350 square foot addition to the rear of the primary structure.  The addition connects the existing primary structure to the existing accessory structure, thus reducing the rear setback for the primary structure to one foot, nine inches.  Minimum allowable rear setback is five feet.  Request a variance of three feet, three inches.  Property is located in a C1, Commercial Office district.

Applicant Kenneth Esry of Larsen Architects proposes the construction of an unroofed patio deck on the existing second story roof.  The proposed unroofed patio deck exceeds the maximum allowable height of 42 inches and maximum allowable area of 300 sq. ft.  Request a variance to exceed maximum allowable height and area.  Property is located in a C3, General Commercial District.

Applicant Bob Bumbarger of Larsen Architects proposes the conversion of a funeral parlor to a multifamily structure.  The renovation of the existing structures will create an additional four apartments.  The required minimum area for a dwelling unit in a multifamily structure is 800 sq. ft.  Two of the proposed units are less than 800 square feet.  Request two variances.  Property is located in a C2, Commercial Retail district.

Applicant David Ellison of the D.H. Ellison Co. proposes the construction of an attached garage to the existing primary structure.  Located on a uniquely shaped parcel that has two fronts yards, parts of the proposed structure would be located in front of the building line.  The required front yard setback is 25 feet.  Request a variance to construct an addition to the primary structure in front of the building line.  Property in located in an R1L, Low Density Single Family Residential District.

Andrew Fleck, Assistant Prosecutor for the City of Lakewood will present a communication to the Board of Zoning Appeals members.  The communication will address various topics and questions from the Board members and may have some data presented from research on past cases, including survey requirements.
