Applicant Mark Common of M. Common Design, proposes the construction of a 15 ft. x 11 ft. pergola with an open roof. The placement of the pergola will reduce the side and rear yard setbacks to less than 3 feet. The property is in the R1L, Single Family Low Density Residential District.

Variance Request: The minimum required side and rear yard setbacks for accessory structures constructed of wood is 3 feet in the R1L district. The proposal reduces the side and rear yard setbacks to less than 3 feet. Pursuant to section 1121.10(a)(1) – additional accessory structure regulations (Ord. 32-16. Passed 9-6-2016).

Applicants Gerald and Christine Swartz propose the demolition of the existing garage and the construction of a 1,000 sq. ft. garage with a garage and several workshops.  The maximum allowable height for an accessory structure is 15 feet, which is a mean height based on the roof type.  The proposed roof is calculated at 19 feet, 8 inches.  Request is for a variance to exceed maximum allowable height of an accessory structure by 4 feet, 8 inches.  Pursuant to section 1121.05(b) passed (Ord. 91-95. Passed 10-7-1996.).  Property is located in the R1M, Single Family Medium Residential district.

Variance Request: The maximum roof height allowable by an accessory structure is 15 feet.  The proposed structure is 19 feet, 8 inches in height.  Request is for a variance to exceed maximum allowable roof height of an accessory structure by 4 feet, 8 inches.  Pursuant to section 1121.05(b) passed (Ord. 91-95. Applicant Curran Kennedy proposes the construction of a patio and a pergola on the west side of his property.  Accessory structures are required to be located in the rear yard.  The request is to place the pergola of 180 sq. ft and 9 feet, 4 inches in height, as proposed in the side yard at 4 feet, 8.5 inches from the side property line.  Pursuant to 1123.09(c) (Ord. 91-95. Passed 10-7-1996.).  Property is located in an R1M, Single Family Medium Residential district.

Variance Request: The proposed structure is only permitted in the rear yard.  The proposed pergola is 9 feet 4 inches in height and 184 inches in length and 142 inches in width (approximately 189 sq. ft. in area) in the side yard between the primary structure and the west side property line. The pergola is proposed to be 4 feet, 8.5 inches from the west property line.  Request is for a variance to place the pergola as proposed in the west side yard.  Pursuant to 1123.09(c) Maximum Lot Coverage (Ord. 91-95. Applicant Robert Swealie proposes the construction of a brick fence with a fireplace.  The fence is proposed at 6 feet and 10 inches in height, 12 inches in width, and a total of 39 feet in length.  A Rumford fireplace, which is attached to the rear wall, will be 12 feet, 4 inches in length at the base, narrowing as it extends above the brick fence to a maximum height of 12 feet.  The base has a maximum width of 4 feet, 6 inches. The proposed brick fence to be constructed 18” from the existing rear and side property fences and property lines.  The rear wall section is 18 feet in length, the west wall is 10 feet in length, and the east wall is 11 feet in length, with the incorporated fireplace comprising a section in the center of the rear wall section.  The remainder of the enclosure walls shown on the drawing are 2-foot knee high walls along the patio which do not require a variance.  Pursuant to section 1153.02(c) (Ord. 91-95. Variance Request: The maximum height of a fence of any type is 72 inches (6 feet).  Request is for a variance to exceed the maximum allowable height by 10 inches for three lengths of brick fence totaling 39 feet in length,  with a width of 12 inches, proposed height of 82 inches ( 6 feet, 10 inches).  Pursuant to section 1153.02(c) (Ord. 91-95. Applicant Jeffery Foster proposes the construction of an addition on the northeast corner of the existing primary structure at 1313 Giel Avenue, in the rear and side yards.  The property is located on a corner and has one existing side yard of approximately 20 feet on the north side of the property.  The proposal would reduce the single side yard to 5 feet.  The minimum combined side yards are required to be 15 feet, the proposal would reduce the combined total to 5 feet.  Pursuant to 1121.07  (Ord. 91-95. Passed 10-7-1996.).   Property is located in the R1H, Single Family High Density Residential district.

Applicant Bud Perry, Arkinetics Architects proposes the adaptive reuse of the commercial building into a mixed-use structure with commercial retail and residential.  The applicant proposes rooftop patio decks on the second and third floor for the residents.  The maximum height for unroofed patio decks is 42” in height, and the maximum area is 300 sq. ft.  Request is for a variance to construct two unroofed patio decks that exceed the maximum height and area.  Pursuant to 1129.03(b) (Ord. 91-95. Passed 10-7-1996.) and 1127.03 (d) (Ord. 24-98. Passed 5-18-1998.).  Property in located in the C2, Commercial Retail District.

First Variance Request : Proposed deck is 260 sq. ft. placed at 16 feet 4 inches above grade. Request a variance to place a 260 sq. ft. unroofed patio deck at 192 inches above grade deck on top of the existing second floor roof on the west side of the building.

Second Variance Request : Request a variance to place a 854 sq. ft. deck at 528 inches above grade on top of the existing third floor roof of the building.

Applicant Mike Pandurevic has installed a fence in front of the building line on his property that exceeds the maximum allowable height.  The maximum allowable height of a fence in the front yard is 36 inches. The fence is 6 feet, 6 inches in height and is comprised of two sections that total 32 feet in length.  Pursuant to 1153.02 (a) (Ord. 91-95. Passed 10-7-1996; Ord. 24-98. Andrew Fleck, Assistant Prosecutor for the City of Lakewood will present a communication to the Board of Zoning Appeals members.  The communication will address various topics and questions from the Board members and may have some data presented from research on past cases, including survey requirements.
