Applicant Daniel Margulies, Daniel Margulies Co., Inc. proposes the conversion of  an existing  two-family residential structure into a single-family structure and the installation of a fence behind the new home. The proposal includes the addition of an unroofed patio deck on the second-floor roof. The variances required for the unroofed patio deck were approved at the February BZA meeting. A variance request to place a fence in front of the building line on Graber (the rear of the home) was deferred and a new site plan has been submitted. The proposal requires an area variance. The entire proposal was approved with conditions by the Architectural Review Board. The property is in the R2, Single- and Two-Family Residential District.

Variance request: Fences in front of the building line must be 36 inches high or less. Request a variance to place approximately 94 feet of 4 foot 6-inch-tall fence that is more than 50% open to the through passage of light and air in front of the building line on Graber.  Pursuant to section 1153.02(a) (Ord. 124- 05. First Variance: The minimum side yard allowed is 10 feet. Request to place Request to place new primary structure 8 feet from the north property line. Request a variance to reduce the side yard by 2 feet. Pursuant to section 1121.07(Ord. 91-95. Passed 10-7-1996.)

The proposal includes a new single-story addition with an 84 square foot unroofed patio deck on the second floor. The proposal exceeds the maximum height of an unroofed patio deck. The property is in the R1H, Single Family Residential District.

The proposal includes the construction of a new two car garage with an attached single-story patio. The proposal exceeds the maximum allowable rear lot coverage. The property is in the R2, Single- and Two-Family Residential District

Variance Request: Maximum rear lot coverage by accessory structures is 25%. The rear lot is calculated as 2,200 sq. ft. Twenty-five percent of the calculated rear lot is 550 sq. ft. Minimum side yard setback is 5 feet.   The property is in the R1H, Single Family Residential District.

Variance Request: Minimum side yard setback required is 5 feet. The existing side yard is non-conforming at 4 feet. The proposal reduces the side yard to 2 feet 6 inches.  Request a variance of 1 foot 6 inches to reduce side yard setback to 2 feet 6 inches. Pursuant to section 1121.07.  (Ord. 91-95. The addition would reduce the front yard setback from the required 50 feet on Lake Avenue to 46 feet. The property is in the R1M, Single family Residential District.

Variance Request The required front yard setback on Lake Avenue is 50 feet. The proposal reduces the front yard on Lake Avenue to 46 feet. Request a variance of 4 feet to reduce the front yard setback to 46 feet. Pursuant to section 1121.07 (Ord. 91-95. Passed 10-7-1996.)
