1509 Arthur Avenue

Property owners Rebecca and Steven Margevicius propose the construction of a 900 sq. ft. addition to their primary residence and the construction of an eight-foot x ten-foot. shed in the side yard. Per code, accessory structures must be in the rear yard. Request is for a variance to construct an 80 square foot shed in the side yard on the south side of the property 18 inches from the side lot line as indicated on the site plan. The shed will be visible from the public right-of-way and requires approval from the Architectural Board of Review (“ABR”).  Pursuant to section 1123.09(c) – maximum lot area coverage.  Property is in an R2, Single and Two-Family district.

1200-02 Belle Avenue

Hermine Rimpf, property owner and applicant proposes the rebuilding of a rear two-story staircase, with small porches on the first and second floor. The second story porch is proposed without a roof.  A variance is required to place an unroofed patio deck above the first-floor elevation.  The variance request is to exceed the maximum allowable height by 108 inches, pursuant to section 1123.03 – permitted accessory uses.  The property is in an R2 –  Single and Two-Family district.

1286 Thoreau Road

David Kermode, property owner and applicant proposes a lot split and consolidation at 1286 Thoreau Road; two vacant parcels to the east of 1286 Thoreau that do not have any frontage.  Lots in the R2 district are required to be 40 feet in width at the building line (on Thoreau the building line is at 20 feet) and to front on an improved street. The applicant is requesting a variance so that he may proceed with a proposed a lot split to create a new parcel that has the required frontage, but less than the required width at the building line on Thoreau. This requires two variances:

  • A variance request to create a lot that does not meet the width requirement at the building line, pursuant to section 1123.06 – lot area and frontage regulations.
  • A variance request to create a lot that does not meet the width requirement at the building line, pursuant to section 1149.053(b)(1) – non-conforming use of structures or structures and land in combination.

The property is in an R2, Single and Two-Family district.

 Marguerite O’Donnell, BC Kitchen and Bath, property owner and applicant, proposes the construction of a small screened-in porch on the rear of her home, reducing the rear yard size to 29 feet, 10 inches; the required rear yard setback is 40 feet. Request is for a variance to reduce the rear set back by 10 feet, 2 inches, pursuant to section 1123.07 – minimum yard requirements for principal buildings.  The property is in an R2, Single and Two-Family district.
